MISS HAMPTONS is the trade name of the company MISS HAMPTONS BRAND, S.L. The present Terms and Conditions regulate the access and use of the website www.misshamptons.com (hereinafter, the Website) owned by MISS HAMPTONS BRAND, S.L. (hereinafter, "MISS HAMPTONS"), with Tax ID No. B54789581 and registered office at Calle Marie Curie, 34, Polígono Industrial, 03203, Elche (Alicante), as well as the services and products offered by MISS HAMPTONS on its website.

MISS HAMPTONS offers this website subject to the following Terms and Conditions. By visiting the website or using the website's services or applications, you agree to these Terms and Conditions.

User registration will not be required to access the website. However, to contract any of the services offered by MISS HAMPTONS, the registration of the user and the acceptance of these conditions will be required before making the payment.

Via the website, MISS HAMPTONS offers sunglasses of the MISS HAMPTONS brand to Users.

The Terms and Conditions of MISS HAMPTONS described below define the rights and obligations of MISS HAMPTONS and the Users within the framework of the Website. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to the fact that for certain services there may be specific conditions) and to the placing of orders through the website, and they replace any other conditions, unless previously agreed in writing between MISS HAMPTONS and the User.

2.- User data

To purchase the products offered through the website it will be necessary for the User to register through the registration form available on the website.

The User will be responsible for keeping the confidentiality of the data and information provided and for restricting access to his or her computer and passwords to avoid possible unauthorized use.

If the User has reason to believe that his/her data has been made known to a third party, or if it has been used in an unauthorized manner, or is likely to be used in an unauthorized manner, he/she must inform MISS HAMPTONS immediately.

The User must check that their details are correct and complete and inform MISS HAMPTONS when there is any variation and/or modification in the information provided in the purchase process.

3.- Orders and sales conditions

The services and products offered through the MISS HAMPTONS website are intended for to be bought by Users of MISS HAMPTONS brand sunglasses.

To get an order from MISS HAMPTONS, the User must be over 18 years of age.

To place orders on the website via the purchase form, the User must provide a series of data before the contracting that will be necessary to manage the purchase order.

4.- Price, payment method and discount codes

Once the form data has been completed, the User must proceed to the payment of the order via the means of payment specified on the website.

After the payment has been made, the User will receive an e-mail confirming the order, which will include a summary of the items purchased, the shipping method requested and the destination address.

If there is an incident during the payment that prevents it from happening, the user will receive an automatic payment error message and the order will not be processed until the payment process is completed successfully.

The prices of the services are expressed in Euros (€), including taxes and operating and shipping costs, the amount of which will be indicated during the final confirmation of each order.

All the prices shown are final prices, the Value Added Tax (VAT) being expressly included, without prejudice to the fact that the user will have broken down information on the price of the product at all times. In the case of the Canary Islands, VAT will be excluded when paying for the order.

MISS HAMPTONS may periodically offer discount codes to its Users. Said discounts may only be applied in accordance with the instructions specified by MISS HAMPTONS regarding each code, and in any case, Users may only use a single code per order.

The use of discount codes will not be compatible with certain promotional actions and collections.

5.- Information on MISS HAMPTONS products and services provided

The data included on the website in each description of the products and services, in their photographs, graphic or iconographic representations or videos as well as trade names, trademarks or distinctive signs of any kind, have a merely informative function. Therefore, MISS HAMPTONS declines any responsibility for the appearance of any mistakes in this information, although it undertakes to take all measures within its power to correct the aforementioned mistakes or omissions as soon as possible after having been informed of them.

7.- Return of defective product and right of withdrawal

7.1 Returns for manufacturing defects

The consumer / user may return to MISS HAMPTONS, free of charge, any product that is defective or does not match the description made for a period of two (2) years from the date on which the product was received. Considering the nature of the products purchased, the consumer / user will have a period of two (2) months after becoming aware of the lack of conformity of the product to communicate it to MISS HAMPTONS via the CONTACT channel enabled for this purpose indicating the defective product or products, attaching photographs and other evidence demonstrating the defects or lack of conformity of the products, as well as a detailed description of the defects found, the purchase order and any other additional documentation that identifies the purchase made by the consumer / user.

Once MISS HAMPTONS has received the communication from the consumer / user and has studied the incident through its Quality Department, it will inform you as soon as possible whether to return the product or not, considering objectively the nature of the product or the nature of the alleged lack of conformity or defect. In the event of a return, MISS HAMPTONS will indicate to the consumer / user how to send the defective product to its warehouses. However, MISS HAMPTONS will not, under any circumstances, be responsible for products that are returned without having been returned by the consumer / user in accordance with the process detailed above.

Each product to be returned must be unused or, if the defect is detected after normal daily use, in the best possible condition, and must be returned with all its labels, packaging and, where appropriate, documentation and original accessories that came with it. If the consumer / user fails to follow this procedure, MISS HAMPTONS and, in particular, its Quality Department, will have to objectively assess the incident by determining whether the product is defective according to its nature and the type of the alleged lack of conformity or defect.

MISS HAMPTONS informs the consumer / user that, considering the features of the products, it will generally not be possible to repair them because it would not be unreasonable. If due to the characteristics of the specific product and the defect, it is possible to repair it, the consumer / user will be expressly informed of this circumstance, giving them the opportunity of choosing between a replacement or a repair.

In line with the above, the consumer / user may replace the defective product for another of identical characteristics, at zero costs for its replacement. If it was not possible to replace the defective product with another of identical characteristics, you will be offered the possibility to choose a new and similar model.

The delivery of the product of identical characteristics or the new model chosen by the consumer / user, as appropriate, will be made within three (3) to five (5) working days from the date on which MISS HAMPTONS confirms to the consumer / user the replacement of the defective product or the delivery of the new model.

If the repair of the product could not be carried out and that the replacement of the product is not in accordance with the contract, the consumer / user may choose to terminate the contract.

MISS HAMPTONS informs consumers and users that the time limit for the refund of amounts paid will depend on the method of payment used by the consumer / user when purchasing the product:

  • Where the User has made the payment by credit/debit card, MISS HAMPTONS will refund the amount paid within fourteen (14) calendar days after the consumer / user decided to terminate the contract.
  • Where the User has made the payment by PayPal, MISS HAMPTONS will refund the amount paid within twenty-four (24) calendar days after the consumer / user decided to terminate the contract.

7.2 Right of withdrawal

The consumer / user will have the right to cancel the order placed remotely without giving any reason, during a period of fourteen (14) calendar days of the correct receipt of the product. The consumer / user may return the entire order or, if you prefer, you can return any of the products that make up the total order and all without penalty and without having to indicate the reasons.

The consumer / user must bear the direct cost of the return to MISS HAMPTONS, whether he/she returns the entire order or decides to return only some products in the order.

To formalize the return, you must contact MISS HAMPTONS at the address www.misshamptons.com/pages/contact. Once said communication has been received, MISS HAMPTONS will indicate the way to send the order to its offices or warehouses.

The consumer / user must send the product to the following offices / warehouses of MISS HAMPTONS: Elche Parque Empresarial, calle Marie Curie, 34, 03203, Elche (Alicante), España.

MISS HAMPTONS is not responsible for the courier company that the consumer / user hires for the return of the order. Accordingly, MISS HAMPTONS recommends the consumer / user to require the courier company to provide proof of delivery once the courier has deposited the product at the offices of MISS HAMPTONS, so that the consumer / user has proof that the product has been returned correctly to MISS HAMPTONSMISS HAMPTONS is not responsible for the address where the consumer / user sends the order for return if this is different from those indicated. MISS HAMPTONS may ask the consumer / user to send this proof of delivery to verify the delivery of the goods.

The costs of returning the order (such as, for example, shipping costs through courier companies) will be borne directly by the consumer / user except for the cost of returning orders that have been made within the national territory of Spain (only applicable to mainland Spain), which will be borne by MISS HAMPTONS who will be responsible for coordinating the collection of products.

The product must be in perfect condition and with all its labels, packaging and, where appropriate, documentation and original accessories that came with it. If the consumer / user does not do so or if the product has been damaged, the consumer / user accepts that the value of the product may be depreciated or that MISS HAMPTONS may refuse the exercise of the right of return by the consumer / user.

Once MISS HAMPTONS verifies that the order is in optimal conditions, MISS HAMPTONS will proceed with the refund of the total amount paid by the consumer / user.

If the consumer / user decides to return the order in full, MISS HAMPTONS will refund the consumer / user the full amount paid by the consumer / user (including the shipping costs related to the delivery of MISS HAMPTONS to the consumer / user).

If the consumer / user only wishes to return one or some of the products that were part of the order, MISS HAMPTONS will not be able to refund the shipping costs that the consumer / user has paid for the entire order.

MISS HAMPTONS informs consumers and users that the time limit for the refund of amounts paid will depend on the method of payment used by the consumer / user when purchasing the product:

  • Where the User has made the payment by credit/debit card, MISS HAMPTONS will refund the amount paid within fourteen (14) calendar days after the consumer / user decided to terminate the contract.
  • Where the User has made the payment by PayPal, MISS HAMPTONS will refund the amount paid within twenty-four (24) to forty-eight (48) business hours after the consumer / user decided to terminate the contract.

In any case, MISS HAMPTONS will refund the amounts paid as soon as possible and within fourteen (14) calendar days from the date on which the consumer / user has informed of his/her decision to withdraw from the contract.

In the case of promotions applicable to the purchase of separate items that include the addition of a further product, being via example, but not limited to, promotions 2x1, 3x1 or any other involving the delivery of an extra product for free or at a reduced price, if the consumer / user decides to apply their right of withdrawal on their purchase, this right will apply to all products provided as part of the promotion.

8.- Product Exchange Policy

MISS HAMPTONS does not allow the change between a product purchased by the consumer / user for another product that is offered on the Website.

If the consumer / user wants to make the change in a product, they must exercise their right of withdrawal on it in accordance with the provisions of clause 7.2 and buy the new product they want subsequently.

9.- Use of the website

The use of the Website for fraudulent purposes, or related to criminal offences or illicit activities of any kind is not allowed.

You are also prohibited from sending, using or reusing any unlawful, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or material that violates intellectual property rights, trademarks, confidentiality, privacy or any other rights, or is otherwise injurious or objectionable to third parties, or that contains software viruses, political propaganda, advertising content, chain letters, mass mailings or any other form of "spam" and, in general, any unnecessary annoyance or inconvenience.

The User undertakes to make lawful, diligent, honest and correct use of any information or content accessed either via the website or third-party websites accessed through links on the website, and all under the principles of good faith and with respect at all times to the law in force and these Terms and Conditions.

Likewise, the User undertakes not to maliciously or intentionally cause damage or harm that may undermine or alter the website itself and not to introduce or spread computer viruses that may cause unauthorized alterations to the contents or the integral systems of the website.

MISS HAMPTONS reserves the right to deny access to the website or even cancel orders to Users who misuse the contents and / or breach any of the conditions that appear in this document.

10.- Intellectual or Industrial property

The intellectual property rights of the website www.misshamptons.com, its source code, design, navigation structures and the different elements contained therein are owned by MISS HAMPTONS, who has the exclusive rights to exploit them in any way and in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with applicable Spanish and European legislation.

MISS HAMPTONS informs that it does not grant any licence or express or implied authorization on the intellectual and/or industrial property rights or on any other right or property related, directly or indirectly, to the contents included on the website. The User is the subject of a random campaign, so the related shipping terms applicable to each order might vary randomly. The User's personal data will not be considered as a variable when determining the particular conditions of each order.

15.- Notifications

All communications between MISS HAMPTONS and the User related to the contracting of orders via the website, will be made in writing and in accordance with the communication procedures set out in these Terms and Conditions for each particular case.

16.- Language

MISS HAMPTONS may translate these Terms and Conditions, its Privacy Policy, or any other operating rules, policies or procedures that might be posted on the website. The Spanish version will be the one that will prevail in case of disagreement.

However, as MISS HAMPTONS continues to grow, it recognizes the importance of being proactive and doing everything possible to defend the rights of the people involved in the manufacture of its products.

  1. Applicable law and jurisdiction

These Terms and Conditions are subject to the Spanish legislation. The parties, in accordance with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, submit themselves to the Courts and Tribunals of the place of residence of the User.

Furthermore, pursuant to the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online consumer dispute resolution, MISS HAMPTONS informs you that, if there is a dispute, the User resident of the European Union may resort to the "Online Dispute Resolution Platform" developed by the European Commission, to attempt to resolve out-of-court any dispute arising from the provision of services by MISS HAMPTONS.

In any case, MISS HAMPTONS informs the User that he / she has Complaint forms through which he/she can make any complaint or claim regarding the services provided by MISS HAMPTONS.
